In this course, students will examine the provincial offences procedural code governing the prosecution and defence of provincial offences in Ontario, including the rationale of a separate and distinct process for dealing with offences that are primarily regulatory in nature, but that can result in imprisonment or loss of livelihood for offenders. Using factual scenarios, students will develop strategies for effectively advancing the prosecution or defence position at pre-trial disclosure, at motion hearings, and at trial. Case studies and court observation reports provide students with the opportunity to analyze evidentiary, procedural, and advocacy issues.
